Student Coverage

Students may or may not be covered by workers’ compensation, depending on their employment status.

Students covered:

  • If you are paying students directly to work in your business, they are considered your workers. You must pay assessments on their earnings and they will be covered in the event of a work-related injury. 
  • If your students are on an unpaid workterm from Memorial University or the College of the North Atlantic, authorized by the educational institution, they are covered under the Act by the provincial Department of Education. You do not have to pay assessments and are protected from liability under the Act.
  • If your students are part of an unpaid high school work term program authorized by the school, they are covered under the Act by the provincial Department of Education. You do not have to pay assessments and you are protected from liability under the Act.

Students not covered:

  • If your students are on an unpaid workterm from a private educational institution or an out-of-province educational institution, they are not covered under the Act. Therefore, you (as the employer) are not protected from liability under the Act and a civil action may be possible in the event of a workplace injury.

 Students who may be covered:

  • If you are hiring students under funding from Employment and Social Development Canada (ESDC), contact us to determine if the ESDC program qualifies for coverage.
