Appealing a Decision

The Workplace Health, Safety and Compensation Commission (the Commission) makes decisions to determine benefit entitlement for worker and employer assessments.

Workers or employers dissatisfied with a decision may request an internal review. The Commission’s final decision is provided in writing.

To request an Internal Review:

Your written request stating the reason for your dissatisfaction must be registered within 30 days of receiving the Commission’s written decision. An internal review specialist will inform you in writing, of the Commission’s final decision. If you still disagree, you have 30 days to request an external review with the Workplace Health, Safety and Compensation Review Division (WHSCRD).

Viewing your file
Under Commission policy, you (or your authorized representative) can access your file. If an injured worker’s claim is being disputed, an employer is only permitted access to information which is relevant to the disputed matter. An employer is not permitted to view a worker’s information.

All requests must be made in writing. Please itemize the information you are requesting and submit to:
